By placing an order or agreeing to these Terms of Service, you confirm that you are 18 years of age or older. If you are not at least 18, you may not use the Service.

To use the Services, including accessing or browsing our online stores or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our stores is correct, current and complete and that you have all rights necessary to provide this information. You are solely responsible for maintaining the security of your account credentials and for all your account activity. We make every effort to ensure that the products offered through the Services are described accurately and that pricing information is current. All essential product characteristics, including materials, sizes, colors and other relevant details, are made available on the product pages. Please note that minor variations in color or appearance may occur due to device settings or lighting conditions.

The price of each product is displayed in euros and includes applicable taxes. Any additional costs, such as shipping or other charges, are displayed separately before you complete your order.

Additional costs, such as shipping fees or other charges, are displayed prior to completing your order. If we detect an error in the price or description of a product, we may cancel the order and notify you without undue delay, issuing a full refund of any amounts paid. 

Prices may change at any time, but such changes will not affect orders in respect of which we have already sent you an Order Confirmation.

All orders are subject to product availability. If there are difficulties in supplying products or if items are out of stock, we will reimburse any amount you may have paid.

 

3. Purchase Procedure

To place an order, you must follow the steps indicated on the website and complete the checkout process. Before confirming your order, you will be provided with a summary of the items selected, the total price (including taxes and applicable charges), and the delivery options. You may review and correct any errors before submitting your order.

Your order constitutes an offer to purchase the selected products. We will send you an email acknowledging receipt of your order; however, this does not constitute acceptance. The contract is concluded once we send you an order confirmation email.

Your order details will be stored electronically. You may request access to your order information at any time by contacting us or by accessing your account, if applicable.

 

4. Payment Methods and Security

We accept the payment methods displayed at checkout. You represent that you are authorized to use the payment method provided. Payments are processed securely through Shopify’s payment infrastructure or other authorized providers using industry-standard encryption technology. We do not store full payment card details on our servers. Your payment information must be complete, accurate and up to date to allow us to process your order. If payment cannot be authorized, the order will not be accepted.

 

5. Shipping, Delivery and Handling

Available shipping methods, estimated delivery times and applicable costs are displayed during checkout. Delivery times are estimates only and may vary due to factors outside our control.

In accordance with Spanish and EU consumer law, if no specific delivery time is indicated, we will deliver the products within 30 days from the date of purchase. If we do not deliver within this timeframe, you may request delivery within an additional reasonable period. If we still fail to deliver, you may terminate the contract and receive a full refund.

Risk of loss or damage to the products passes to you only when you or a person designated by you (other than the carrier) has taken physical possession of the goods.

 

6. Right of Withdrawal, Returns and Exchanges

If you are a consumer residing in the European Economic Area, you have the right to withdraw from your purchase within 14 days from the date you receive the products, without needing to provide a reason. To exercise this right, you may follow the instructions in our Refund and Returns Policy.

To comply with the withdrawal period, it is sufficient that you notify us of your decision before the withdrawal period expires. Upon withdrawal, we will refund all payments received from you, including standard shipping costs, within 14 days from the date we are informed of your decision. We may withhold the refund until we receive the returned products or until you provide proof of return.

Certain products may be excluded from the right of withdrawal if permitted under applicable law (e.g., sealed goods that are unsealed after delivery and are not suitable for return for hygiene reasons). Any applicable exclusions will be stated clearly on the product page.

 

7. Legal Guarantees 

Nothing in these Terms affects the legal guarantee of conformity established under Spanish and EU law. Products must be delivered in conformity with the contract, and you are entitled to a free of charge remedy if the product is defective or does not conform.

In Spain, the legal guarantee for consumer goods is three years from the date of delivery. If a product is defective or non conforming, you may request repair or replacement. If neither remedy is possible or proportional, you may request a price reduction or termination of the contract. These remedies are provided at no cost to you.

Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection and arrangement thereof, are owned by Antihero Studios, its affiliates or licensors. These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any of the material on the Services without our prior written consent. Except as expressly provided herein, nothing in these Terms grants, or shall be construed as granting, any license or other rights to you under any patent, trademark, copyright or other intellectual property of Antihero Studios, Shopify or any third party. Unauthorized use of the Services may infringe applicable intellectual property laws. All rights not expressly granted herein are reserved by Antihero Studios. Antihero Studios’s names, logos, product and service names, designs and slogans are trademarks of Antihero Studios or its affiliates or licensors. You must not use such trademarks without the prior written permission of Antihero Studios. Shopify’s name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs and slogans on the Services are the trademarks of their respective owners.

We may correct or update such information at any time. If an error or inaccuracy affects an order you have already placed and the correction materially impacts your purchase (for example, in the case of an obvious pricing error), we may cancel the order. Where this occurs, we will notify you without undue delay and refund any amounts you have paid in full.

This disclaimer does not affect the legal guarantee that applies to products purchased through the Services, nor any mandatory consumer rights.

18.  Limitation Of Liability

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law or any rights you may have as a consumer under Spanish or EU law concerning the sale of goods. To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special or consequential losses that were not foreseeable at the time the contract for sale was formed, including loss of profits, loss of revenue, loss of business, or loss of data. Our total liability to you for any claim arising out of or in connection with the sale of products through our website shall not exceed the amount you paid for the product that gave rise to the claim. This limitation of liability does not affect your statutory rights as a consumer, including your rights relating to the conformity of products, delivery, returns, and refunds under Spanish and EU consumer protection law.

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions. 

20. Waiver; Entire Agreement 

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service). Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.

You may not delegate, transfer or assign this Agreement or any of your rights or obligations under these Terms without our prior written consent, and any such attempt will be null and void. We may transfer, assign, or delegate these Terms and our rights and obligations without consent or notice to you. 

22. Governing Law 

Sales of products through our website are governed by Spanish law. This does not affect any mandatory consumer protection rights you may have under the laws of your country of residence. If you are a consumer, any dispute relating to these Terms or to your purchase will be handled by the courts that have jurisdiction under applicable consumer law. For disputes that are not subject to mandatory consumer jurisdiction rules, the parties agree to submit to the courts of Barcelona, Spain.

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms. 

24. Changes To Terms of Service 

The most current version of these Terms is available on this page. We may amend or update these Terms at any time by posting the revised version on our website and, where required by law, providing notice of any material modifications. Such amendments shall take effect on the date indicated in the notice. Continued access to or use of the Services after the effective date of the revised Terms shall constitute acceptance of the modifications.
